Terms of Service

This agreement (“Agreement”) is made between the Client and Bobby Built Developments Inc. (the “Contractor”). By entering into this Agreement, both parties agree to the following terms and conditions:

1. Scope of Work

• The Contractor will provide all necessary work permits (only materials), tools, specified equipment, and materials to commence the roofing project.
• The Contractor has sole discretion over employee headcount, considering project timelines.

2. Scheduling

Project timelines may be adjusted due to:

• Extreme heat/cold temperatures.
• Rain, snow, or excessive winds.
• material delays

3. Insurance

• The Contractor maintains liability insurance coverage of $2,000,000. Not including onsite materials.

4. Limitation of Liability

• The Contractor is not liable for damages caused by misuse or neglect.
• Liability is limited to the cost of services provided.
• The Contractor is not responsible for theft of materials.

5. Workplace Maintenance

• The Contractor will ensure daily workplace cleanliness and proper storage of tools and materials to minimize risks.
• The Client acknowledges that dust accumulation is normal during the project and its cleanup is not the Contractor’s responsibility.

6. WorkSafe NB Compliance

• The Contractor’s WorkSafe NB account is active and in good standing for 2025, with monthly payroll reporting and assessments paid.

7. Payment Terms

• The Client must pay the remaining balance upon project completion. Overdue payments incur 7.99% interest every 30 days.
• Financing is available through Financeit, subject to approval. Clients remain responsible for payments regardless of third-party funding.
• Additional charges may apply for unforeseen circumstances, including but not limited to rot, mold, asbestos, or unsafe environments, customer change request.
• Bobby Built Developments Inc. reserves the right to use third-party collections for any unpaid invoices.
• Reserves the right to place lien for nonpayment.

8. Initial Down Payment

• A 50% deposit of the contract price is required before work begins.

9. Refund Eligibility

• Refund requests must be submitted in writing within 30 days of the project start date.
• A restocking fee of 25% and an administration fee of 5% will be deducted from any refund for returned products.

10. Warranties and Guarantees

• Workmanship warranties vary by product. Touch-ups must be requested within three days of project completion; otherwise, a warranty claim is required.
• Materials are covered by manufacturer warranties.
• Additional work, including replacing rotten materials, removing extra shingle layers, or snow removal, is subject to additional costs.

11. Intellectual Property

• All website content, including logos and trademarks, is owned by Bobby Built Developments Inc. and may not be used without written permission.

12. Dispute Resolution

• Disputes will be resolved through legal arbitration.
• This Agreement is governed by Canadian and New Brunswick laws.

13. Updates to Terms

• These terms may be updated as needed. Clients are encouraged to review them periodically.
• By signing or accepting an estimate and paying a deposit, you agree to the Terms Of Services.
